Portugal's new deed rule: the título urbanístico requirement from 1 October 2026

From 1 October 2026, the document formalising the transfer of urban building land, a building or an autonomous fraction must state the position of the property's título urbanístico. Omitting the statement is sanctioned, in the text of the rule itself, with the transaction becoming voidable — anulável. This page reproduces the rule and cites its source.

What changes
Article 3.º of Decreto-Lei n.º 108/2026 of 29 May inserts a new article 4.º-A, headed "Títulos urbanísticos", into Portugal's planning and building code (RJUE). That article's n.º 14 creates a new duty for whoever draws up the transfer.
The duty binds, in the words of the rule, "o conservador, o notário, o advogado, o solicitador ou outra entidade legalmente competente" — the registrar, the notary, the lawyer, the solicitador, or another legally competent entity. It covers transactions "que envolvam a transmissão de terrenos para construção urbana, de edificações já construídas ou em construção, ou das suas frações autónomas": the transfer of urban building land, of buildings already built or under construction, or of their autonomous fractions.
The rule requires a statement to be recorded. It does not require the professional to verify or certify that the property is lawful. What the document must now contain is the declared position of the title, in one of three forms.
The list in n.º 14 is closed: urban building land, buildings built or under construction, and autonomous fractions. A prédio rústico transferred as rural land does not fall within it.
The three permitted statements
The full text of n.º 14, as enacted by Decreto-Lei n.º 108/2026. It is reproduced here in Portuguese because that is the operative language of the rule:
Na realização de negócios jurídicos que envolvam a transmissão de terrenos para construção urbana, de edificações já construídas ou em construção, ou das suas frações autónomas, deve o conservador, o notário, o advogado, o solicitador ou outra entidade legalmente competente, sob pena de anulabilidade do negócio jurídico, fazer menção no documento que o titula:
a) À existência do título urbanístico correspondente, quando lhe seja apresentado;
b) À declaração do transmitente de que dispõe do título urbanístico correspondente, quando este não lhe seja apresentado;
c) À declaração do transmitente de que não dispõe de título urbanístico.

Unofficial translation. In transactions involving the transfer of urban building land, of buildings already built or under construction, or of their autonomous fractions, the registrar, the notary, the lawyer, the solicitador or another legally competent entity must, on pain of the transaction being voidable, state in the document formalising it: a) that the corresponding urbanistic title exists, where it is produced to them; b) the transferor's declaration that they hold the corresponding urbanistic title, where it is not produced to them; c) the transferor's declaration that they do not hold an urbanistic title.
The three options are not equivalent. Option a) is the title produced; option b) is the seller's declaration that they hold it, without producing it; option c) is a declaration that no title exists.
Option b) satisfies n.º 14 without the title ever being shown to the professional drawing up the document: the formality is met, and the buyer has not seen the document set described in n.os 2 and 4. It is, predictably, the statement most likely to appear in practice.
The sanction: anulabilidade
The sanction sits in the body of n.º 14 itself: the duty binds the professional "sob pena de anulabilidade do negócio jurídico" — on pain of the transaction becoming voidable. It is not a formality without consequence.
Portuguese civil law distinguishes a negócio nulo from a negócio anulável, and they are different regimes. Article 286.º of the Civil Code provides, as to the first, that "A nulidade é invocável a todo o tempo por qualquer interessado e pode ser declarada oficiosamente pelo tribunal." The diploma did not take that route: it chose anulabilidade, which has restricted standing and a time limit.
The regime is in article 287.º of the Civil Code, applicable "na falta de regime especial" — absent a special regime — under article 285.º:
1. Só têm legitimidade para arguir a anulabilidade as pessoas em cujo interesse a lei a estabelece, e só dentro do ano subsequente à cessação do vício que lhe serve de fundamento.
2. Enquanto, porém, o negócio não estiver cumprido, pode a anulabilidade ser arguida, sem dependência de prazo, tanto por via de acção como por via de excepção.
Código Civil, artigo 287.º
Unofficial translation. 1. Only those in whose interest the law establishes the anulabilidade have standing to invoke it, and only within the year following the cessation of the defect on which it is founded. 2. While, however, the transaction has not been performed, the anulabilidade may be invoked, with no time limit, whether by action or by way of defence.
Two points to hold on to. The default period is one year from the cessation of the defect. But while the transaction has not been performed, n.º 2 dispenses with the period altogether: the anulabilidade may be invoked, by action or by defence, with no time limit.
One point is worth stating plainly. Article 287.º n.º 1 confines standing to the "pessoas em cujo interesse a lei a estabelece" — those in whose interest the law establishes it — and not to any interested party, which is the test for nulidade. And Decreto-Lei n.º 108/2026 does not say in whose interest it establishes this anulabilidade. The common formula that "either party may challenge the sale" is therefore not what the general regime provides. Who will have standing under this new rule, and from when the cessation of the defect runs, are questions the diploma leaves open and the courts will settle.
Article 288.º n.º 1 adds that "A anulabilidade é sanável mediante confirmação." — it can be cured by confirmation, which nulidade cannot.
The general regime is cited above. How it applies to this new rule — in whose interest the anulabilidade is established, and when the defect ceases — is not settled.
What counts as a título urbanístico
The diploma uses the term but does not define it in a definitions article. What article 4.º-A does — and its heading is precisely "Títulos urbanísticos" — is specify which documents constitute the title for each procedure. For a licence, n.º 2 provides:
A licença é titulada, para todos os efeitos legais, pelo comprovativo do pagamento das taxas e demais encargos devidos, pelo último requerimento entregue, devidamente preenchido, que contém a síntese da operação urbanística, e: a) Pela notificação do seu deferimento, caso este seja expresso; b) Pelo comprovativo da submissão, em caso de deferimento tácito.

N.º 4 does the equivalent for the comunicação prévia and the comunicação prévia com prazo. Put differently: the title is not a single stamp — it is the set of documents the law attaches to whichever procedure was followed.
Two consequences worth separating. First: declaring under option c) that no title exists satisfies the formality without curing the substance. The property still has no título urbanístico — there is now simply a written, signed confirmation of that in the transfer document.
Second: the same article, at n.º 13, provides that «O título de utilização de edifícios ou frações autónomas é transmitido automaticamente com a propriedade a que respeita.». That rule concerns the título de utilização — the use title — and its passing with the property. It does not turn a property without a construction title into a titled one, and it does not dispense with the statement required by n.º 14.
Dates and transition
The operative date is 1 October 2026. Article 2.º of Decreto-Lei n.º 155-B/2026 of 31 July gave article 13.º of Decreto-Lei n.º 108/2026 a new wording: «O presente decreto-lei entra em vigor no dia 1 de outubro de 2026.»
That replaced the original wording, which read: "O presente decreto-lei entra em vigor no primeiro dia útil do terceiro mês seguinte ao da sua publicação, com exceção do disposto no número seguinte." Read against a publication date of 29 May 2026, the rule pointed to the first working day of August (1 and 2 August fell at the weekend, so Monday 3 August). The July diploma superseded it.
On transition, the distinction that matters is the rule's own: the duty attaches to the document that formalises the TRANSMISSION. A promissory contract of purchase and sale is a promise to transmit — it is not the transmission.
For a promissory contract signed before 1 October with the deed afterwards, the diploma is silent: it contains no transitional provision on this. In the absence of one, whoever draws up the transmission applies the regime in force at the date of the transmission.
Why the rule exists
The diploma's preamble supplies its own framing:
Ademais, e tendo em vista assegurar o desejável equilíbrio entre a necessária segurança jurídica e o respeito pela liberdade nas transações imobiliárias, assegura-se um ajustamento a este regime, prevendo-se que, na realização de negócios jurídicos que envolvam a transmissão de propriedade de prédios urbanos, deve constar do contrato se o imóvel dispõe ou não de título urbanístico, assumindo-se assim a aquisição consciente e informada.
Decreto-Lei n.º 108/2026, de 29 de maio — preâmbulo
Note that the preamble speaks of the "transmissão de propriedade de prédios urbanos" — a broader formulation than n.º 14's own list. It is the article, not the preamble, that sets the scope.
The patterns the rule catches are recognisable and depend on no particular case:
- The off-plan purchase where the title — whether a licença or a comunicação prévia — never came into being, and the buyer finds out only when they ask for it.
- The annex or extension regularised on paper — on the tax register, at the land registry — but never with the municipality.
- The embargoed development where fractions have already been deeded, and n.º 14 now forces the title's position onto the page.
What to do before signing
Ask for the título urbanístico before the promissory contract, not on the day of the deed. The n.º 14 statement appears in the transfer document — by which point a deposit has been paid and a deadline is running.
Establish which of the three options is being prepared for your transaction. Option a) is the one that corresponds to a title that exists and was produced. Option c) is not a procedural step: it is written confirmation, in the document formalising your purchase, that the property has no título urbanístico.
If the option being prepared is b), note what it means: the formality is satisfied without the title having been shown to whoever draws up the document. Treat it as a flag to follow, not as the equivalent of option a).
This needs verifying before you commit.
